When you create an account, access the PezScales dashboard, or otherwise use our products and services (the “Service”), you are agreeing to these Terms of Service (the “Terms”). If you do not agree, you must not use the Service.

“PezScales”, “we”, “us”, and “our” refer to the PezScales entity that provides the Service to you. “You” and “your” refer to you as an individual user or, where applicable, the organization you represent.

Messaging Consent Info

By opting in to our SMS services, you agree to receive text messages related to notifications, marketing offers, account authentication (2FA), and other service-related communications. Message frequency may vary.

Standard message & data rates apply according to your mobile carrier's terms.

To opt out of SMS communications at any time, reply STOP to any message you receive. If you need assistance, you can text HELP for support.

By using PezScales' messaging service, you agree to receive various communications—including alerts, reminders, and promotional offers—at a frequency that varies based on your interaction. Standard message and data rates apply, and while delivery is not guaranteed due to potential network delays, you maintain full control with the ability to opt-out at any time by replying STOP.

All users are legally obligated to use the service professionally and in compliance with privacy and telecommunications laws, ensuring no offensive or harmful content is transmitted, while your data remains protected under the company's Privacy Policy.

1. Acceptance of Terms

By accessing or using the PezScales website, applications, APIs, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms referenced herein or presented to you as part of specific features or offerings. If you do not agree to these Terms, you may not access or use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and “you” in these Terms will refer to both you as an individual and that organization.

2. Eligibility & Account Registration

You may use the Service only if you are at least the age of majority in your jurisdiction and are legally capable of forming a binding contract, and only in compliance with these Terms and all applicable laws. You must provide accurate and complete information when creating your account and keep your account information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must promptly notify us of any unauthorized use of or access to your account. PezScales is not liable for any loss or damage arising from your failure to safeguard your account.

3. Use of the Service & Acceptable Conduct

Subject to your compliance with these Terms, PezScales grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes or personal use. You agree that you will not, and will not permit others to:

  • Use the Service in any manner that violates applicable laws or regulations.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying structure of the Service, except to the extent such restrictions are expressly prohibited by law.
  • Access the Service to build a competing product or service, or copy any ideas, features, or functions of the Service.
  • Interfere with, disrupt, or compromise the integrity or performance of the Service or data contained therein.
  • Attempt to gain unauthorized access to the Service or its related systems or networks.
  • Upload, transmit, or store malicious code, spam, or content that is unlawful, harmful, fraudulent, infringing, defamatory, or otherwise objectionable.

4. Content & Intellectual Property

Your data. You retain all rights to any data, content, or materials that you submit to or store in the Service (“Customer Data”). You grant PezScales a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Customer Data solely as necessary to provide and improve the Service and as otherwise permitted by these Terms.

PezScales materials. The Service, including all software, documentation, designs, interfaces, graphics, and other materials provided by PezScales (“PezScales Materials”), are owned by or licensed to PezScales and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you, and all such rights are reserved by PezScales and its licensors.

You may not remove, obscure, or alter any proprietary notices on or within the Service. Any feedback, suggestions, or ideas you submit about PezScales may be used by us without restriction or obligation to you.

5. Data, Privacy & Security

Our handling of personal data is described in our Privacy Policy, which is incorporated by reference into these Terms. You are responsible for ensuring that your use of the Service, and your provision of Customer Data to PezScales, complies with all applicable data protection laws.

You acknowledge that the Internet is inherently insecure and that we cannot guarantee absolute security. However, we maintain commercially reasonable technical and organizational measures designed to protect Customer Data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access.

6. Fees, Subscriptions & Changes to the Service

If you subscribe to a paid plan, you agree to pay all applicable fees in accordance with the pricing and billing terms presented to you for that plan. Unless otherwise stated, fees are non-refundable. We may modify our fees and pricing from time to time, and any changes will apply at the start of your next billing cycle after notice is provided, where required by law.

We may add, remove, or modify features, or suspend or discontinue the Service (in whole or in part), at any time. Where required and feasible, we will provide reasonable advance notice of material changes that adversely affect your use of the Service.

7. Termination & Suspension

You may stop using the Service at any time. If you wish to terminate a paid subscription, you may need to follow the cancellation instructions provided in your account or in the applicable order form. Unless otherwise specified, termination will take effect at the end of your then-current billing period.

We may suspend or terminate your access to the Service, in whole or in part, immediately and without prior notice if we reasonably believe that: (a) you have violated these Terms; (b) your use of the Service poses a security risk or could cause harm to us or others; or (c) we are required to do so by law. We will have no liability to you for any termination or suspension of your access to the Service in accordance with these Terms.

8. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEZSCALES AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PEZSCALES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED, IN THE AGGREGATE, THE AMOUNTS PAID BY YOU TO PEZSCALES FOR THE SERVICE DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to the law or to the Service. When we make material changes, we will provide notice by posting the updated Terms on this page and updating the “Last updated” date, and we may also notify you through the Service or by email where appropriate. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes.

10. Governing Law & Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which PezScales is organized, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the Service will be resolved in the courts located in that jurisdiction, unless applicable law requires otherwise. You and PezScales consent to the personal jurisdiction and venue of those courts.

Can I use PezScales for any type of project?

You can use PezScales for most lawful business or personal analytics projects. You must not use the Service for illegal activities, to infringe on others’ rights, or to create or distribute harmful or abusive content, as outlined in the Acceptable Use section of the Terms.

Who owns the data I upload to PezScales?

You remain the owner of the data you upload or connect to PezScales. We only process your data to provide and improve the Service, in accordance with these Terms and our Privacy Policy.

How will I know if the Terms change?

When we make material changes to the Terms, we update the “Last updated” date at the top of this page and may also notify you via email or in-app notifications where appropriate. If you continue using the Service after changes take effect, you are agreeing to the updated Terms.

How do I close my account?

You can usually close your account from within your PezScales settings, or by contacting our support team. Ending your account stops your future use of the Service, but it does not automatically erase all historical data, billing records, or logs we are legally required to keep.
